Open Access Policy

The Indonesian Court and Justice Review (ICJR) is committed to providing immediate and unrestricted open access to all of its published scholarly content.

The journal believes that making academic research freely available to the public supports the advancement of knowledge, promotes scholarly communication, and increases the visibility and accessibility of research on courts, judicial institutions, legal systems, and justice.

1. Immediate Open Access

All articles published by ICJR are made immediately and freely accessible online upon publication.

Readers may access, read, download, search, and use the journal's published content without subscription or registration requirements, subject to the terms of the applicable license.

ICJR does not impose an embargo period on access to published articles.

Open access applies to articles published in both regular issues and Special Issues.

2. Open Access Model

ICJR operates under a Gold Open Access model.

Under this model, the final published version of an article is made freely available on the journal's official website immediately upon publication.

The journal does not restrict access to published articles through paywalls or subscription requirements.

3. Copyright and Licensing

Unless otherwise indicated on the individual article, ICJR publishes articles under the Creative Commons Attribution 4.0 International (CC BY 4.0) License.

Under the CC BY 4.0 license, readers and other users may:

share the published work by copying and redistributing the material in any medium or format;
adapt, remix, transform, and build upon the material for any purpose, including commercial purposes;

provided that appropriate credit is given to the original author(s), a link to the applicable license is provided, and any changes made to the original material are indicated.

The full terms of the applicable Creative Commons license are available through the journal's website.

4. Author Rights

Authors retain appropriate rights in their scholarly work subject to the journal's copyright and licensing agreement.

Publication in ICJR does not prevent authors from:

sharing their published article;
depositing the article in institutional or subject repositories;
using the article for teaching and research purposes;
distributing the article to colleagues and students; and
incorporating the work into subsequent scholarly publications, subject to appropriate acknowledgment of its original publication in ICJR.

Authors are encouraged to share their published work through legitimate institutional, disciplinary, and academic repositories to increase the accessibility and visibility of their research.

5. Reader Rights

Readers may access and use published articles in accordance with the license applicable to each article.

Users are permitted to:

read and download articles;
print copies for personal or educational use;
share links to published articles;
cite and reference published works;
reuse material within the terms of the applicable license; and
create adaptations where permitted by the applicable license.

Proper attribution to the original author(s) and publication in ICJR is required.

6. Open Access and Publication Fees

Open access to ICJR articles is not dependent on reader subscription or payment.

Any article processing charge (APC), submission fee, publication fee, or other author charge applicable to publication shall be clearly disclosed by the journal before manuscript submission.

Editorial decisions are independent of an author's ability or willingness to pay publication-related charges.

Where no APC or publication fee is charged, the journal shall explicitly state this on its website.

7. No Paywall

ICJR does not place its published research behind a paywall.

Readers do not need to purchase individual articles or maintain a journal subscription to access the final published version of an article.

The journal's commitment to open access applies equally to researchers, students, practitioners, policymakers, legal professionals, institutions, and members of the public.

8. Digital Preservation and Long-Term Access

ICJR recognizes that open access requires not only free access at the time of publication but also reasonable measures to preserve the scholarly record for future access.

The journal is committed to maintaining appropriate digital preservation and archiving arrangements for its published content.

Where possible, published articles may also be preserved through recognized institutional, disciplinary, or third-party digital preservation and repository services.

Information concerning the journal's specific digital preservation arrangements will be made publicly available on the journal website.

9. Open Access and Academic Integrity

Open access does not reduce the journal's academic or editorial standards.

All manuscripts remain subject to the journal's applicable editorial screening, peer review, publication ethics, plagiarism, research integrity, and authorship policies.

The same academic standards apply to articles published in regular issues and Special Issues.

10. Accessibility and Discoverability

ICJR seeks to maximize the accessibility and discoverability of its published research through appropriate scholarly indexing, metadata dissemination, repository practices, and digital preservation.

The journal encourages authors to use persistent identifiers, including ORCID where appropriate, and to provide accurate bibliographic and author information to facilitate scholarly discovery and citation.

11. Open Access and Special Issues

All articles published as part of a Special Issue are subject to the same open access principles as articles published in regular issues.

Special Issue publication does not create a separate subscription requirement, embargo, or access restriction unless explicitly stated in the applicable licensing information.

12. Policy and Licensing Transparency

ICJR provides clear information concerning its open access model, copyright, licensing, author rights, and applicable publication charges on its official journal website.

Any significant changes to this Open Access Policy will be publicly communicated and will not retroactively alter the rights associated with previously published articles unless legally required or otherwise agreed with the relevant rights holders.

13. Commitment to Open Scholarly Communication

ICJR considers open access an important component of responsible scholarly communication.

By making research freely available, the journal seeks to facilitate international academic exchange and broaden access to scholarship concerning courts, justice, judicial institutions, and legal developments in Indonesia and comparative jurisdictions.

ICJR is committed to continuously improving its open access, licensing, preservation, and dissemination practices in accordance with recognized international standards for scholarly publishing.
