Copyrights and Licensing Policy

The Indonesian Court and Justice Review (ICJR) respects the intellectual property rights of authors and is committed to ensuring that authors retain ownership and control of the copyright in their scholarly work.

1. Copyright Ownership

Authors retain the copyright in their articles and do not transfer or assign copyright to the Indonesian Court and Justice Review.

Copyright remains with the author(s) from the time of submission through publication and thereafter.

Publication of an article in ICJR does not constitute a transfer of copyright ownership from the author(s) to the journal, Editorial Board, publisher, or any other party.

2. No Copyright Transfer

ICJR does not require authors to transfer, assign, or surrender copyright as a condition of publication.

Authors retain copyright without restriction and remain the copyright holder of their published work.

The journal's publication process does not prevent authors from exercising their rights as copyright owners.

3. License to Publish

By submitting a manuscript and agreeing to publication, authors grant ICJR a non-exclusive, worldwide, royalty-free license to publish, reproduce, distribute, communicate, display, index, archive, and make the article available as part of the journal's scholarly publication.

This license is limited to the purposes necessary for the publication, dissemination, preservation, indexing, and academic communication of the article.

The license granted to ICJR does not constitute an assignment or transfer of copyright ownership.

4. Author's Rights

Because authors retain copyright, they may use, reproduce, distribute, and otherwise reuse their work without requesting permission from ICJR, subject to applicable law and the terms of any third-party material incorporated into the article.

Authors may, in particular:

  • share the published article with colleagues, students, and research communities;

  • deposit the article in institutional, subject-based, or other lawful repositories;

  • publish or distribute the article on personal or institutional websites;

  • use the article for teaching and educational purposes;

  • reproduce the article in books, book chapters, conference materials, or other scholarly works;

  • create derivative or adapted versions of the work;

  • translate the article into other languages;

  • reuse portions of the article in subsequent scholarly works; and

  • grant additional non-exclusive permissions or licenses to third parties.

Authors are not required to obtain prior permission from ICJR for these activities.

Where the article has already been published by ICJR, authors should provide an appropriate acknowledgment of the original publication.

5. Open Access License

ICJR publishes articles under an open access model.

Where the article is published under a Creative Commons Attribution 4.0 International (CC BY 4.0) License, the license permits third parties to share and adapt the work, including for commercial purposes, provided that appropriate attribution is given, a link to the license is provided, and changes are indicated.

The application of a Creative Commons license does not transfer copyright ownership from the author to ICJR.

The author remains the copyright holder.

6. Third-Party Material

Authors are responsible for ensuring that they have the necessary rights, permissions, or legal basis to reproduce third-party material included in their manuscripts.

Third-party materials may include:

  • photographs;

  • figures;

  • tables;

  • maps;

  • datasets;

  • substantial quotations;

  • previously published materials; and

  • other copyrighted works.

Material that is not owned by the author may be subject to separate copyright or licensing conditions.

Where necessary, authors must obtain appropriate permission and clearly identify third-party material and its applicable rights.

7. Moral Rights

Nothing in the publication agreement is intended to limit the author's moral rights or other rights that cannot lawfully be transferred or waived under applicable law.

Authors retain the right to be properly identified as the creator of their work and to protect the integrity of their scholarly contribution, subject to applicable law.

8. Subsequent Publication and Reuse

Authors may subsequently publish, reproduce, adapt, translate, or otherwise reuse their article or substantial portions of it in other scholarly works.

Authors should acknowledge the article's original publication in ICJR when appropriate.

Subsequent publication does not require permission from ICJR, provided that such reuse complies with applicable copyright law, third-party rights, and the terms of any applicable open license.

9. Preprints and Repository Deposits

Authors may deposit and share versions of their manuscripts in appropriate repositories or other lawful scholarly platforms, subject to applicable third-party rights and licensing conditions.

Publication in ICJR does not prevent authors from making their research available through legitimate scholarly communication channels.

10. Copyright Infringement

ICJR may assist authors, where appropriate, in addressing unauthorized reproduction or other infringement of the copyright in an article published by the journal.

Because copyright remains with the author, authors retain the primary legal rights and remedies available to copyright holders under applicable law.

11. Editorial and Publication Rights

The journal retains the right to:

  • determine whether a manuscript meets its editorial and scholarly standards;

  • conduct editorial and peer review procedures;

  • format and typeset accepted articles;

  • assign bibliographic metadata;

  • publish the article in its journal platform;

  • preserve and archive the published version;

  • disseminate the article through indexing and scholarly discovery services; and

  • maintain the integrity of the journal's published record.

These rights are granted through the non-exclusive license to publish and do not constitute ownership of the copyright.

12. Copyright Notice

Unless otherwise indicated, the copyright statement accompanying an article published by ICJR shall identify the author(s) as the copyright holder.

The journal will provide clear information concerning the applicable copyright and licensing terms on the article landing page and within the published version of the article.

13. No Restriction on Author's Copyright

ICJR does not impose restrictions that prevent authors from retaining or exercising their copyright.

Authors do not surrender copyright as a condition of:

  • submission;

  • peer review;

  • acceptance;

  • publication;

  • open access dissemination; or

  • continued publication of the article in ICJR.

The journal's role is to publish, disseminate, preserve, and facilitate access to the author's scholarly work while respecting the author's ownership of copyright.

14. Policy Statement

ICJR's copyright policy is based on the principle that scholarly authors should retain ownership of the intellectual property they create.

Accordingly:

Authors retain full copyright in their work. No copyright is transferred or assigned to the Indonesian Court and Justice Review. The journal receives only the non-exclusive rights necessary to publish, disseminate, preserve, and index the work.

This policy applies to articles published in regular issues and Special Issues of ICJR.

Any future amendment to this policy will be publicly communicated through the journal's official website and will not retroactively alter the copyright ownership of articles already published unless otherwise required by applicable law.
