Copyrights Policy

Lentera Masyarakat Hukum is committed to protecting authors' intellectual property rights while facilitating the broad dissemination, accessibility, and reuse of scholarly work. The journal operates under an author-retained copyright and Creative Commons Attribution 4.0 International (CC BY 4.0) licensing model.

1. Copyright Ownership

Copyright remains with the author(s).

Authors retain full copyright and other applicable intellectual property rights in their published work. Submission and publication in Lentera Masyarakat Hukum do not require authors to transfer copyright ownership to the journal, publisher, or Editorial Board.

By publishing with the journal, authors grant Lentera Masyarakat Hukum a non-exclusive right to publish, reproduce, distribute, display, archive, and make the article publicly available as the original publisher.

This publishing right does not constitute a transfer of copyright ownership.

2. Creative Commons Licensing

All articles published by Lentera Masyarakat Hukum are licensed under the:

Creative Commons Attribution 4.0 International (CC BY 4.0) License.

The CC BY 4.0 license permits anyone to:

  • copy and redistribute the published material in any medium or format;

  • remix, transform, and build upon the material;

  • use the material for academic, educational, professional, or commercial purposes; and

  • create derivative works based on the published article.

These rights are granted provided that appropriate attribution is given to the original author(s) and source, a link to the license is provided, and any modifications are indicated.

3. Author Rights

Because copyright remains with the author(s), authors are free to:

  • share the published article with colleagues and the public;

  • deposit the article in institutional, subject, or public repositories;

  • publish the article on personal or institutional websites;

  • use the article for teaching and educational purposes;

  • reproduce the article in books, edited volumes, or other scholarly publications;

  • translate, adapt, or develop derivative works;

  • use the article for commercial or non-commercial purposes; and

  • authorize others to reuse the work under the terms of CC BY 4.0.

Authors are not required to request permission from the journal for uses already permitted under the CC BY 4.0 license.

4. Author's Declaration

By submitting a manuscript, authors confirm that:

  • they have the legal right to submit the work for publication;

  • the manuscript is original or that all relevant third-party material has been appropriately acknowledged and licensed;

  • publication of the manuscript will not knowingly infringe the intellectual property rights of others;

  • all authors have agreed to the submission and publication of the work; and

  • any necessary permissions for copyrighted third-party material have been obtained.

5. Third-Party Material

Authors are responsible for identifying any material in their manuscript that is owned by third parties.

Third-party content may include:

  • photographs;

  • illustrations;

  • maps;

  • tables;

  • figures;

  • datasets;

  • substantial quotations; and

  • other copyrighted materials.

Where required, authors must obtain appropriate permission from the copyright holder before publication.

Material that is not covered by the article's CC BY 4.0 license should be clearly identified in the published article.

6. Attribution and Reuse

Users may freely reuse articles published by Lentera Masyarakat Hukum, including for commercial purposes, under CC BY 4.0.

Any reuse must provide appropriate attribution, including:

  • the name(s) of the author(s);

  • the title of the article;

  • the journal name;

  • publication information;

  • the DOI or other persistent identifier, where available;

  • a link to the original publication; and

  • a link to the CC BY 4.0 license.

Users must indicate if changes have been made to the original material.

7. Moral Rights and Attribution

The journal recognizes that copyright licensing does not eliminate applicable moral rights or the author's right to appropriate attribution.

Users must not falsely represent another person's work as their own or imply that the original author or journal endorses a particular adaptation or use when no such endorsement exists.

8. Commercial Use

The CC BY 4.0 license permits commercial use of published articles without requiring additional permission from the journal or authors, provided that the terms of the license are followed.

Commercial reuse does not transfer copyright ownership from the original author(s).

9. Repository and Self-Archiving Rights

Authors may deposit and make their published articles available through:

  • institutional repositories;

  • subject repositories;

  • national or international research repositories;

  • personal websites;

  • university websites; and

  • other legitimate academic dissemination platforms.

No embargo period is imposed by the journal on author self-archiving of the published version.

10. Copyright Infringement

The journal takes copyright infringement seriously.

If the journal receives a credible allegation that a published article infringes the copyright or other intellectual property rights of a third party, the Editorial Board may investigate the matter and take appropriate action.

Depending on the circumstances, actions may include:

  • requesting clarification from the author;

  • requesting correction of the published material;

  • removing or replacing unauthorized third-party material where appropriate;

  • issuing a correction or editorial notice;

  • temporarily restricting access where legally necessary; or

  • retracting the article in serious cases where the integrity or legality of the publication is substantially compromised.

11. Relationship with Open Access Policy

This Copyright and Licensing Policy operates together with the journal's Open Access Policy.

The journal's publishing model is based on three fundamental principles:

  1. Copyright remains with the author(s);

  2. Articles are immediately and freely accessible; and

  3. Published articles are licensed under CC BY 4.0.

This model enables the widest possible dissemination and reuse of scholarly work while ensuring that authors retain ownership and receive appropriate attribution.

12. Policy Updates

The journal may periodically review and update this policy to reflect developments in copyright law, open access publishing, Creative Commons licensing, and scholarly communication practices.

Any material changes will be communicated through the journal's official publication platform.
