Faith, Justice, and the State: The Influence of Theology on Indonesia’s Political and Legal Systems

The relationship between religion, politics, and law in Indonesia is complex, with religious teachings playing a pivotal role in shaping the nation’s legal and political systems. This paper explores how theological concepts of justice have influenced the formation and evolution of Indonesia's political and legal frameworks. Focusing on both Islamic and Christian theological perspectives, the study examines how faith-based values intersect with the state’s constitutional principles, policies, and laws. The research traces the historical role of religion in shaping Indonesia’s legal system, from the inclusion of religious values in the Pancasila (the national ideology) to contemporary debates surrounding religious laws and human rights. The paper argues that while Indonesia's political system is officially secular, religious ideas continue to influence public policy, particularly in areas such as family law, education, and social welfare. The study further explores how theological interpretations of justice can either support or challenge state actions, particularly in relation to human rights, gender equality, and religious freedom. Recommendations include strengthening the separation of religious teachings from state policies, promoting legal reforms that align with international human rights standards, and fostering a more inclusive approach to justice that respects both religious diversity and secular governance.
